ABC and Radio Adelaide settle name dispute out of court

The injunction against the ABC’s use of the name ABC Radio Adelaide has been lifted.

 
It was in December Radio Adelaide successfully sought a court injunction against the ABC Adelaide’s 891 which was to be rebranded as ABC Radio Adelaide.
 
The ABC was legally bound not to rename 891ABC Adelaide to ABC Radio Adelaide until court action concluded.
 
Both stations have now reached an agreement that the name ABC Radio Adelaide can be adopted, which will bring Adelaide into line with ABC brandings used in other capital cities.
 
“We had to weigh up the risk of losing the case and the cost of that along with the cost of rebranding,” said Iain Evans Radio Adelaide.
 
“We decided it best to put the money into improving the station.”
 
When asked by radioinfo it was a genuine David and Goliath battle, Mr. Evans replied, “yes.”
 

A spokeswoman from the ABC told radioinfo , “…ABC Radio will move forward with its proposed name change from ABC Adelaide (formerly 891 ABC Adelaide) to ABC Radio Adelaide, (with accompanying logo) in line with ABC stations in other capital cities around Australia.
 
“This will happen from this week onwards.
 
“The ABC is pleased to have reached a commercial resolution of this matter so that it will not proceed to trial
 

“We do not feel there will be confusion in the marketplace between the two stations. Our identity is led by the ABC brand in all locations and on all platforms.

“Our brand evolution to ABC Radio Adelaide ensures that at all times, ‘ABC’ or the ABC Wave logo will accompany the words ‘RadioAdelaide’, when used descriptively on-air, visually in promotional material or otherwise.”
