Apparently unhappy about being labelled “Dodgy Dene” and “The Cross Country Conman” Dene Broadbelt says he has engaged a Bateman’s Bay legal firm, Bayside Lawyers, to commence proceedings against those who have allegedly maligned him.
Firmly in his sights is an unnamed announcer, now working in Bendigo, along with a Sunshine Coast Social Media and Website Design Firm who have been sent a “cease and desist” notice. The notice demands “that they cease and desist from spreading false, destructive, and defamatory material concerning Broadbelt’s business dealings and private affairs.”
No description of exactly what that “false, destructive, and defamatory material” is has been offered and radioinfo has been unable to find anything in connection with Mr Broadbelt on the station’s website.
The full media release reads:
Ex Australian Radio Personality Dene Broadbelt said his lawyers have sent a legal notice to a [details removed] radio announcer and Sunshine Coast social media and website design firm for making “defamatory” allegations against the former “Australian radio announcer”.
In a letter, from Bayside Lawyers to the alleged defamation duo it advises “We refer in particular to defamatory material assembled and disseminated to the detriment of our client by the private Facebook account of an organisation known as “The Dene Broadbelt Support Group”. Our client emphatically denies the truth of that material.”
Mr Broadbelt, said that his lawyers have sent a “cease and desist” notice to the [details removed] announcer and a Sunshine Coast Social Media And Website Design Firm and demanded a “that they cease and desist from spreading false, destructive, and defamatory material concerning Broadbelt’s business dealings and private affairs.
The action came after several news reports’ quoted that Broadbelt “had faked his own death to escape from authorities”, some publications also titled Mr Broadbelt as “Dodgy Dene” and “The Cross Country Conman”.
“The Duo have made serious allegation’s on the internet, to the media and Broadbelt’s past employers without a scrap of correct evidence to back it up some of the alleged that the duo are referring to have never had any dealings with Mr Broadbelt”.
The letter also stated that Bayside Lawyers “are not averse to the freedom of speech and recognise the value of fair comment. At this time our client has no desire to commence legal proceedings and we are keen to do all we can to avoid litigation.
Mr Broadbelt also advised that his lawyers “are preparing another cease and desist notice for a media outlet that advised the public that Broadbelt was “Found Dead with out verifying their source of information.”
It is a known fact that this Mr Broadbelt has sent out "cease and desist" letters from other lawyers from around the country to a number of persons who have spoken out about Mr Broadbelt.
it has been reported that the lawyer/s never got paid for their services.
In one case a letter was sent from Mr Broadbelt also claiming that a lawyer from Sydney was also requesting that another radio personality cease and desist, the lawyer in question was contacted and he denied any knowledge of Mr Broadbelt and this lawyer has since sent a letter to Mr Broadbelt to cease and desist from making counterfeit letters using his business name.
I hope that Bateman’s Bay legal firm, Bayside Lawyers have better luck in getting paid for their services.
Mr Broadbelt’s proceedings against anyone will be hollow as in the past, defamatory" allegations have to be untrue for a case to be brought against anyone.
Oh dear, Peter. What are you thinking? Giving this individual a larger profile? Unless this story is written in a thoughtful way in which more than this person can benefit from it, it will not be viewed positively by many.
Friends working in law often say that defamation action swings between the extremes of rich man's sport to that of intimidation against the vulnerable (often both).
To pursue a civil proceeding of defamation is not a cheap. Litigation is costly, the legislation ensures a costly amount of time in court and leading up to it.
Maybe you should check out Broadbelt’s story to see if infact he has engaged the Bateman’s Bay legal firm, Bayside Lawyers, first reports coming back from this business are suggesting that they don’t have a Broadbelt on their list of clients
Mr Broadbelt has in the past counterfeited letters from other legal business.
