Seems to me NOVA are just spammers. I would simply put them in the same folder as the rest of the junk mail we all get.
Yeah i think all is fair, i know that any company recieveing anothers data base would market to them. I think that the only people who would be anoyed would be the ones at fox who sent the email in the first place. When i heard about this i had a good chuckle :)
As mush as I find it clever and witty for what Nova did -
#1 FOX should keep their security and privacy settings up to date. What would have happened if it was something else and someone's credit card details were given out? (EXAMPLE ONLY)
#2 NOVA invaded privacy of others. If they wanted to be apart of NOVA, they would have signed up to NOVA.
Both are at fault.
Look people, it might be called spam by some but it is just the same as if I was to give my companies database to GE Capital Finance for example. They would send people on my list, info on getting finance and all I would do is throw it in the bin. People need to get on with life, and it is as easy as pressing delete on your mail program.
That's what happens when you trust technology and people using the technology. I remember TTFM (Mix 101.1) had something like this happen a couple of years back. That was a technology fault, and there were multiple emails sent to people on their database as well. Fun and games. And lots of explaining to be done. How quickly people forget.
All's fair in love and war... or radio and war!. I'm sure Fox would have done the same thing had Nova made the mistake they did, and Nova would have been stupid to let an opportunity like that pass them by! It would be interesting to know how many Fox listeners have now switched to Nova after that e-mail though!
'accidentally' landed in their laps? hmmm.
apart from a couple of privacy issues at play here - this is just another example of the 'unconvential' marketing tactics nova is becoming famous for and one of the main reasons why they are making such a dent in melb/syd/perth. legal ramifications aside: wouldn't you have jumped on this opportunity too?
as for the question "will it win NOVA 'new' audience"? probably not. infact: you'll find there's already a great deal of audience sharing going on (between NOVA & FOX/2DAY). besides: if FOX listeners wanted more music - wouldn't they switch to CDs in the car. (ps. who plays more music at breakfast? NOVA or FOX? last time i checked - neither).

Nova Capitalised on a tactical mistake by fox and i dont blame them... Seriously.
Which radio exec would'nt of taken up that opportunity.You'd be mad if you didn't. It just shows you that there are now more of a means of playing the game called radio tactics. yes it can and may get nasty...but it's smart. and on the ball radio execs who play smart and know what their doing can really really take advantage of this.
At the end of the day, they did what they had to do (Nova) and did it well. I mean the extra publicity out of all this from the station will probably do wonders for them and increase their ratings. It's a shame Fox had to carry on like a cry-baby because no doubt, if Nova had made the same mistake, Fox would have done the same thing. But when all is said and done, if the music-mix, line-up and programming is better than the competition, people will listen to it, so i think it's just a matter of time before Nova becomes #1 fm station in Melbourne.
I would use caution, depsite the strong temptation. The question to be asked is, how did they get? and once you have that answer, then you can plan you're next move.
Depending on the circumstances of how it arrived, for me the potential legal consequences have to be given the highest consideration. I personally think, build you're own listeners, if youre product is good enough you will have all of the listeners you will need.
