ABA Responds to leaked ABC report

The ABA has come out with a strong statement, in response to the Media Watch report quoting a draft investigation document.

The Authority says it is aware that a draft report of its investigation into a complaint about coverage of the Iraq War by ABC radio’s ‘AM’ has been the subject of media coverage.

Acting ABA chief, Lyn Maddock, says: “I am concerned that contents of a draft report have been made public without the opportunity for parties who may be adversely affected by the publication of the report to make representations to the ABA.

“In accordance with the ABA’s usual practice for investigating complaints, a draft investigation report was provided to the ABC on 16 August 2004 for comment. The ABC has made substantial comments about this draft report, comments that the ABA is still considering.

“The ABA does not intend to finalise or publish a report on the investigation until satisfied that the legal requirements have been met, and the usual administrative processes have been completed.

“The preliminary report is a draft, provided in confidence to to the ABC for their comment to provide natural justice. This is standard practice in relation to ABA investigations, so all potentially affected parties have the opportunity to make representations to the ABA about the report.

“The ABA will have careful regard to comments it has received in response before finalising its views. At that time, it will publish detailed reasons for its decisions on each of the matters, taking account of the submissions of the ABC and other persons who may be adversely affected by the publication of the report.

“The contents of any leaked preliminary report should not be treated as decisions of the ABA, nor can the ABA properly comment or speculate on issues before the investigation.”
