Court judgement in favour of World Audio

Justice McDougall of the NSW Supreme Court this week delivered his judgement in World Audio’s action against GB Radio (Australia) Pty Limited.

He found that by the agreement of 2nd April 2002, WorldAudio Communications Pty Limited, WorldAudio Limited’s wholly owned subsidiary, has a lease of ACA Broadcast Apparatus licences #1130395 1620AM “Melbourne” and #1130396 1611AM “Sydney”.

The leases include “a valid option to purchase each of those licences.”

Justice McDougall also found that WorldAudio Communications Pty Limited had validly exercised its option to purchase the Sydney licence.

He directed that formal orders be brought in by 31st October 2003 to give effect to his judgement, allowing World Audio to broadcast on its Sydney frequency without interference, and to embark on its expansion into Melbourne and other cities.
