Developments in the Caralis case

More documents filed in Caralis copyright case.

The copyright action against Super Radio Network’s Bill and Pam Caralis has moved one more step forward, with the case listed for a closed court mention today.

radioinfo’s court source says today’s listing is to set a date for the next directions hearing.

According to court listings, two additional documents were filed yesterday by Adobe. Super Network filed its defence on the 31st of May and yesterday Adobe filed, presumably in response to the defence, an Interlocutory Application, which is a document specifying temporary orders the company asks the court to impose on the network.

A spokesperson for the Business Software Alliance, representing plaintiffs Microsoft and Adobe, would not comment as today’s listing, as is being held in closed court.

As reported previously on radioinfo, Microsoft and Adobe have brought the copyright action against Caralis and Super Network for using unlicensed and pirated software.

Of the two documents filed yesterday, the more interesting of the two is a Notice of Discontinuance filed by Adobe. Usually, such notices are in relation to a previously filed application or response. In this case, Adobe may just be removing the previously filed Interlocutory Application, or, as details of the notice are unknown, it fuels the speculation that an out of court settlement is being arranged.

The next Court date is listed for June 19, where a Directions and Interlocutory hearing is set to occur.
